Welcome to the Honda Civic Brake Pad Settlement website. Capitalized terms not otherwise defined herein shall have the same meaning ascribed to them as in the class action Settlement Agreement And Release. This website provides information about the settlement of a lawsuit concerning brake pads on certain Settlement Class Vehicles (2006-2011 Honda Civics, DX and LX trims only). If you purchased or leased one of the cars described above, you are a member of the Settlement Class and you may be entitled to certain benefits, described in detail in the Class Notice.

This proposed settlement was preliminarily approved by the Court on May 1, 2014. The Final Approval Hearing was held on February 27, 2015. (Rescheduled date) The Court granted final approval of the Settlement on June 9, 2015, and the settlement became final on July 9, 2015 (the "Effective Date"). AHM will provide the benefits to eligible Settlement Class Members described in detail in the Settlement Agreement and Class Notice and more briefly below.

YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT 

  • SUBMIT A CLAIM FORM
    This is the only way to get reimbursement for Out-Of-Pocket Expenses. If you timely submit a valid Claim Form with a repair invoice or receipt or similar documentation and proof of payment for a qualified repair, you can obtain reimbursement of eligible repair expenses based on a schedule set forth in the Settlement Agreement and Release. Settlement Class Members are required to complete and submit a timely Claim Form to receive any monetary benefits under the settlement. The time to submit a Claim Form is set for in the Claim Form itself and the Class Notice.

  • ASK TO BE EXCLUDED
    You must act by January 21, 2015. To exclude yourself or “opt out” of the Settlement Class, you must follow the procedures outlined in the Class Notice. If you exclude yourself from the Settlement Class, you cannot receive any of the benefits of the Settlement or comment upon the Settlement, but you will not be bound by the Final Order and Judgment.

  • COMMENT OR OBJECT
    You must act by January 21, 2015. If you are a member of the Settlement Class and you do not Opt Out, you may object to the terms of the Settlement, the Attorneys’ Fees and Expenses, and/or the incentive awards to the class representatives. To object to the Settlement, you must follow the procedures outlined in the Class Notice. You must remain a member of the Settlement Class (i.e., you cannot ask to be excluded) in order to object to the Settlement, and if the Settlement is approved, you will be bound by the Final Order and Judgment.

  • DO NOTHING
    If you do not sign and return a Claim Form within the timeline specified in the Settlement Agreement, you will not be able to claim benefits under the Settlement, but you will be bound by the Court’s judgment. You will also give up any rights to sue American Honda Motor Co., Inc., and any other Released Person, separately about the claims in this lawsuit.

  • ATTEND THE FINAL APPROVAL HEARING
    You must act by January 21, 2015. The Final Approval Hearing is scheduled to be held on February 20, 2015. Any member of the Settlement Class may attend the Final Approval Hearing. Any member of the Settlement Class who does not request exclusion may also enter an appearance through counsel, but all fees and costs of such counsel are the responsibility of the member of the Settlement Class. If you wish to attend, or have your attorney attend the hearing on your behalf, to address the Court during the hearing, you must send a letter to the Honda Settlement Administrator, to Class Counsel, or AHM’s Counsel at the addresses indicated in the Class Notice, stating that you are commenting on the settlement in Zakskorn, et al. v. American Honda Motor Co., Inc., Case No. 2:11-cv-2610-KJM-KJN, and including your: full name; mailing address; telephone number; approximate date of purchase or lease; model year(s) of your Class Vehicle(s); vehicle identification number(s) (“VIN”) of your Class Vehicle(s); statement that you have reviewed the Settlement Class definition and understand that you are a Settlement Class Member; explanation of your factual and legal grounds for objecting; copies of any documents supporting your objection; and signature.
