The Court in charge of this case previously granted Final Approval of the settlement on March 27, 2014. It has been determined, however, that Settlement Class Members with Settlement Class Vehicles registered in the state of Washington as of September 18, 2013 were inadvertently not mailed direct notice of the settlement (the “Omitted Owner Group”). Click here for a copy of the Supplemental Notice sent to members of the Omitted Owner Group at the Court’s direction. The Court held a supplemental hearing on April 22, 2016 at 10:00 a.m. providing members of the Omitted Owner Group an opportunity to object or exclude themselves from the previously approved nationwide settlement. Following the hearing, the Court issued an Order closing the judgment as to all Settlement Class Members. The period for submitting Claim Forms has now closed. Timely submitted Claim Forms will be processed, and any approved payments will issue within the next several weeks. Please check back for additional updates.

Welcome to the Honda Engine Misfire Settlement website. Capitalized terms not otherwise defined herein shall have the same meaning ascribed to them as in the Class Action Settlement Agreement And Release. This website provides information about the settlement of a lawsuit concerning Engine Misfire and its symptoms and causes in the Settlement Class Vehicles (i.e., 2008-2012 Honda Accord; 2008-2013 Honda Odyssey; 2009-2013 Honda Pilot; 2010-2011 Honda Accord Crosstour; and 2012 Honda Crosstourequipped with a 6-cylinder engine with Variable Cylinder Management (“VCM-2”)). If you purchased or leased one of the cars described above, you are a member of the Settlement Class and you may be entitled to certain benefits, described in detail in the Class Notice.

This proposed settlement was preliminarily approved by the Court on October 9, 2013. The Final Approval Hearing was held on March 21, 2014, and the Court entered its Final Approval Order on March 27, 2014. The settlement is now Final. On or before June 30, 2014, the Settlement Administrator expects to begin mailing reimbursements of eligible Out-of-Pocket Expenses to Settlement Class Members who have already received notice from the Settlement Administrator that their Claim for reimbursement was accepted and approved.

For Settlement Class Members whose claims were denied in whole or in part, and whose Claims are subsequently approved in whole or in part by the Settlement Administrator after a valid and timely request for reconsideration, reimbursements for eligible Out-of-Pocket Expenses are expected to be mailed beginning in September 2014. Please check this website regularly for updates from the Settlement Administrator.

This is the only way to get reimbursement for Out-Of-Pocket Expenses. If you timely submit a valid Claim Form with a repair invoice or receipt or similar documentation and proof of payment for a qualified repair, you can obtain full reimbursement of eligible repair expenses. Settlement Class Members were required to complete and submit a Claim Form by April 10, 2014, to receive any monetary benefits under the settlement. The time to submit a Claim Form has now closed and no Claim Form postmarked after April 10, 2014, will be accepted.

Please note that the time to submit a request to opt out of the settlement February 24, 2014, has now closed and no request to exclude postmarked after February 24, 2014 will be accepted.

Please note that the time to submit a comment or objection to the settlement has now closed, and the Court has granted final approval to the settlement.

Receive the warranty extension, but get no reimbursement. Give up your rights to sue. By doing nothing, you will obtain the benefit from the Engine Misfire warranty extension, but you will not obtain reimbursement of Out-Of-Pocket Expenses. You will also give up any rights to sue American Honda Motor Co., Inc. (“AHM”) separately about the claims in this lawsuit.

Please note that the Final Approval Hearing was held on March 21, 2014. The Court granted final approval to the settlement by order entered March 27, 2014. The Court also granted Class Counsel’s Motion for Attorneys' Fees and Expenses and Plaintiff's Incentive Award. The attorneys’ fees awarded to Class Counsel will be paid directly by AHM and will not reduce the benefits available to the Settlement Class Members.

All of your rights and options under the proposed settlement are explained in detail in the court-approved Class Notice. Please check this website regularly for updates from the Settlement Administrator.

Thank you.
